Terms of service

Aloud runs AI-simulated usability sessions against customer-selected websites or applications and produces evidence, findings, and recommendations. Simulated participants are not human research participants, customers, or a statistically representative sample. Results are designed for product discovery and triage, not as a substitute for human research, professional advice, accessibility conformance testing, security testing, or a warranty that a product is fit for use.

Aloud may change, add, or remove service features. Preview, beta, or evaluation features may be less reliable and may change without notice. We may impose reasonable technical limits to protect the service, providers, and other customers.

You must provide accurate account information and keep access to your email account, devices, runner credentials, share links, and workspace secure. You are responsible for activity under your account and for assigning appropriate workspace roles. Notify us promptly if you suspect unauthorized access.

Do not share a personal sign-in session or runner token with someone who should not have access. We may rely on instructions from an authenticated account until we receive and can act on notice that it has been compromised.

You may test only a website, application, account, or environment that you own or are authorized to test. You are responsible for the study instructions, target, accounts, data, allowed domains, and actions you approve.

Use staging or a seeded test environment whenever practical. Use scoped test accounts instead of real credentials. Review any action that could purchase, publish, delete, invite, message a person, change permissions, or otherwise affect production data before approving it. Aloud's controls reduce risk but do not transfer responsibility for the target system or an approved action to Off Script Foundry.

You retain ownership of the URLs, instructions, content, screenshots, evidence, and other material you submit or generate through your use of Aloud (“Customer Content”). You grant Off Script Foundry a limited, non-exclusive right to host, copy, transmit, analyze, transform, and display Customer Content only as needed to provide, secure, support, and improve the service, follow your instructions, and meet legal obligations.

You represent that you have the rights and permissions needed for Customer Content and for Aloud to process it. Do not submit information that applicable law, a contract, or your own policies prohibit you from sharing with Aloud or its providers.

You may not use Aloud to violate law or another person's rights; access systems without authorization; conduct vulnerability scanning, credential attacks, surveillance, harassment, fraud, or malware activity; evade safety or usage limits; disrupt the service; reverse engineer non-public portions except where law permits; resell access without written permission; or upload unlawful, infringing, or malicious content.

You may not direct an AI participant to collect secrets, real payment credentials, government identifiers, protected health information, or other sensitive data that is unnecessary for the study. If you discover sensitive information in evidence, stop sharing it and delete or report it promptly.

AI behavior and generated results can be incomplete, inaccurate, inconsistent, or unsuitable for your situation. You must review evidence and exercise independent judgment before relying on a finding, changing a product, or taking another consequential action. You are responsible for decisions made from Aloud output.

Outputs may not be unique, and another user may receive similar material. Off Script Foundry does not claim ownership of your Customer Content or Aloud reports, but no right is granted to third-party material that may appear in a tested product or output.

Aloud relies on third-party hosting, authentication, storage, payment, analytics, and AI providers. Their availability may affect the service. A tested website, connected repository, or other customer-selected service remains subject to its own terms. Off Script Foundry is not responsible for a third-party service outside its control.

Prices, included credits, trial terms, renewal timing, and plan-specific limits are shown before checkout and form part of these terms. Stripe processes payments. You authorize the charges shown at checkout and must keep billing information current. Taxes may apply.

Subscriptions renew until canceled. You may manage or schedule cancellation through the billing portal; cancellation takes effect as described there. Except where the checkout terms say otherwise or law requires, fees already paid are not automatically refundable. Billing questions can be sent to the contact address on this page.

Off Script Foundry and its licensors retain rights in Aloud, including its software, design, documentation, branding, and service technology. These terms give you only the right to use the service while the agreement is in effect.

If you provide feedback, you allow Off Script Foundry to use it without restriction or compensation, but we will not publicly identify you as its source without permission.

You may stop using Aloud at any time and may cancel a paid plan through the billing portal. We may suspend or terminate access if you materially breach these terms, create a security or legal risk, fail to pay amounts due, or use the service in a way that could harm Aloud, a provider, or another person. When practical, we will give notice and an opportunity to cure.

After termination, your right to use the service ends. Provisions that by their nature should survive will survive, including payment obligations, ownership, disclaimers, limits of liability, and dispute terms. Data is handled according to the Privacy Policy and applicable deletion workflows.

To the fullest extent permitted by law, Aloud is provided “as is” and “as available.” Off Script Foundry disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the service will be uninterrupted, error-free, secure, or produce a particular result. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.

To the fullest extent permitted by law, Off Script Foundry will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business interruption arising from Aloud, even if advised that they were possible.

To the fullest extent permitted by law, Off Script Foundry's total liability arising from Aloud will not exceed the amount you paid for the service during the 12 months before the event giving rise to the claim, or US $100 if you paid nothing. These limits do not apply where liability cannot lawfully be limited.

We may update these terms as the service changes. We will update the effective date and provide additional notice for material changes when required. Continued use after updated terms take effect means you accept them; if you do not agree, stop using the service.

Before filing a formal claim, contact us and give us a reasonable opportunity to resolve the issue informally. These terms do not prevent either party from seeking urgent relief or using rights that applicable law does not allow the parties to waive.
